1. Acceptance of Terms

By requesting a quote, booking services, or otherwise engaging with The Texas Loo, LLC (“we,” “our,” or “us”), you (“Customer,” “you,” or “your”) agree to these Terms of Service. These Terms supplement the signed rental agreement governing each rental; where the signed rental agreement and these Terms conflict, the signed rental agreement controls. Please read them carefully.

2. Services Provided

The Texas Loo provides mobile restroom trailer rentals and related sanitation services for events, job sites, and emergency response needs. Service availability is subject to scheduling, inventory, and location.

3. Quotes and Reservations

• Quotes are estimates based on information provided by the customer and are subject to change.
• Reservations are not confirmed until a signed rental agreement and deposit are received.
• Availability is on a first-come, first-served basis.

4. Customer Responsibilities

• Customer must provide safe and accessible placement locations for trailers, including adequate space, level
  ground, and utility hookups if required (e.g., water, power, septic).
• Customer is responsible for obtaining any permits required by local authorities.
• Customer is responsible for any damage to equipment while on site, excluding normal wear and tear.

5. Service Conditions

• The Texas Loo reserves the right to refuse or discontinue service if unsafe conditions exist.
• Scheduled servicing (cleaning, pumping, restocking) will be provided according to contract terms. Additional servicing is available upon request and may incur extra charges.

6. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, THE TEXAS LOO, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR DELAYS OR FAILURES CAUSED BY EVENTS BEYOND OUR REASONABLE CONTROL, INCLUDING WEATHER, TRAFFIC, OR UTILITY OUTAGES. THIS LIMITATION APPLIES EVEN IF SUCH DAMAGES ARE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE TEXAS LOO, LLC. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY CUSTOMER FOR THE SERVICES DIRECTLY RELATED TO THE CLAIM.

7. INDEMNIFICATION

CUSTOMER AGREES TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THE TEXAS LOO, LLC, ITS OWNERS, EMPLOYEES, AND CONTRACTORS FROM ANY CLAIMS, DAMAGES, OR EXPENSES ARISING OUT OF CUSTOMER’S USE OF THE RENTED EQUIPMENT OR SERVICES, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE TEXAS LOO, LLC, EXCEPT TO THE EXTENT CAUSED BY OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT. NOTHING IN THESE TERMS WAIVES ANY RIGHT THE CUSTOMER MAY HAVE UNDER THE TEXAS DECEPTIVE TRADE PRACTICES CONSUMER PROTECTION ACT.

8. Governing Law and Venue

These Terms of Service are governed by and construed in accordance with the laws of the State of Texas. The parties agree that any dispute arising out of or relating to these Terms or the services should be brought in the state courts located in Montgomery County, Texas, to the extent permitted by applicable law.

9. Changes to Terms

We may update these Terms of Service from time to time. The latest version will always be posted on our website with the effective date noted above.
